NOVA VITAL PEPTIDES – FULL LEGAL WAIVER AND LIABILITY RELEASE

As this is a legal waiver that could affect your legal rights, you are encouraged to have this reviewed by your own attorney before signing. 

This Legal Waiver and Liability Release (“Agreement”) is entered into by the individual submitting this form (“Participant”) and Nova Vital Peptides (“Company”), including its owners, officers, employees, contractors, representatives, subsidiaries, D/B/A’s, successors and/or assigns, and any affiliates and agents (collectively, the “Released Parties”). By accessing this website, submitting this form, or engaging with any information or materials provided by the Company, including the purchase and/or use of any product referenced herein, the Participant agrees to the following terms:

1. Age Verification

By submitting this form, the Participant affirms and certifies that they are 21 years of age or older and legally capable of entering into this Agreement. (Why 21?) 18 is age of majority and for entering into a contract.

2. Research, Promotional and Educational Use Only

All information, materials, products, compounds, descriptions, or references provided by the Company are intended solely for research, promotional, laboratory, and educational purposes.

Nothing on this website, nor anything communicated by the Company, constitutes:

  • medical advice,

  • diagnosis,

  • treatment, or

  • any form of healthcare recommendation.

No product herein,  is intended for human consumption, clinical application, or therapeutic use.

3. No Medical Relationship

The Participant understands and agrees that:

  • The Company is not a medical provider.

  • No physician–patient, clinical, or professional healthcare relationship is created.

  • All decisions made by the Participant are their sole responsibility.

The Participant agrees to consult their own physician or qualified healthcare professional before making any decisions related to peptides, bioregulators, or any other related materials.

4. Assumption of Risk

The Participant acknowledges the inherent risks associated with handling, studying, using, or possessing of the products and/or materials referenced herein.

By proceeding, the Participant voluntarily assumes:

  • all risks of use,

  • all risks of misinterpretation or misunderstanding of the information provided herein, and

  • all risks associated with the use of any products referenced herein.  

The Participant understands that improper handling or misuse of products and research materials herein, can cause property damage, personal injury, or other adverse outcomes.

5. No Liability; Release of Claims

To the fullest extent permitted by law, the Participant hereby waives, releases, and forever discharges the Company and all Released Parties from any and all:

  • claims,

  • demands,

  • lawsuits,

  • liabilities,

  • damages,

  • expenses,

  • losses,

  • actions or causes of action of any kind,

arising from or related to:

  • the use or possession of any products or research materials herein,

  • the interpretation or application of any information provided by the Company,

  • any decisions made by the Participant based on such information,

  • or any other interaction with the Company.

This waiver applies regardless of cause, including but not limited to negligence (except where prohibited by law).

6. Non-Litigation Agreement

The Participant agrees not to initiate, join, or participate in any lawsuit, arbitration, claim, or other legal proceeding against the Company or any Released Party for any matter arising from:

  • information provided,

  • materials referenced,

  • Products mentioned and/or purchased,

  • ensuring safe handling of any product or research materials,

  • and seeking independent legal and/or medical advice as needed.

10. Entire Agreement

By submitting this form, the Participant acknowledges that they have read, understand, and voluntarily accept the terms of this Agreement in full.

This Agreement supersedes all prior representations, communications, or understandings.

Acknowledgment & Consent

By submitting this form, I certify that:

  • I am 18 years of age or older.

  • I understand that all information and materials from Nova Vital Peptides are for research, promotional and educational purposes only.

  • I acknowledge that nothing presented constitutes medical advice or treatment.

  • I voluntarily assume all associated risks.

  • I waive all legal claims and agree not to file any lawsuit or legal action against Nova Vital Peptides or its representatives.

  • I have had this waiver reviewed by an attorney of my choosing or have waived the same.

  • My submission and electronic signature shall be considered binding on me as if I had signed an in person, wet signature.

By submitting, I agree to all terms of this Legal Waiver and Liability Release.
